The 12th issue of Gaopeng Criminal Lecture Hall: "Frontier Theory and Criminal Defense of Virtual Currency Crime" Special Lecture Successfully Held
Autumn has passed and winter has come, hoping for the warm sun. By the window, the residual light is shining, making it easy to read. On the afternoon of November 17, 2023, the 12th edition of the Gaopeng Criminal Lecture Hall was held as scheduled. In this lecture, Professor Ma Mingliang, a second level police supervisor and doctoral supervisor from the Investigation School of People's Public Security University of China, and Lawyer Wu Xiaohui, a senior partner of the institute, were invited to share a special topic on "Frontier Theory and Criminal Defense of Virtual Currency Crime", hosted by Lawyer Dong Xiaohua, Director of the Gaopeng Criminal Commission.

Ma Mingliang
Professor Ma Mingliang has in-depth research and unique insights into information technology judicial applications such as criminal procedure law, corporate compliance, artificial intelligence, and blockchain. In this lecture, Professor Ma first gave a macro introduction to the emergence of virtual currencies such as Bitcoin, as well as the current trading situation in China and globally; Then, from the perspective of underlying technology and application, a detailed interpretation was made of the connection and difference between blockchain and virtual currency; Finally, the regulatory and criminal status of virtual currencies in China and other countries around the world were elaborated on from the perspectives of the situation of the amount involved, types of crimes, investigative difficulties, and judicial application challenges. Professor Ma's explanation is easy to understand and easy to understand, which has greatly benefited the audience.

The second half of the lecture will be delivered by Lawyer Wu Xiaohui. Lawyer Wu first analyzed the legal nature of virtual currency, the risks of virtual currency trading, and legal regulations from various aspects such as national ministerial documents and civil law. Subsequently, a summary was made of the main types and characteristics of current virtual currency crimes, including specialization in criminal techniques, concealment of criminal activities, scale of criminal gangs, diversification of criminal types, and typical cross regional characteristics. Finally, Lawyer Wu took the case of opening a casino involving virtual currency as an example and analyzed the criminal subject, subjective and objective aspects, calculation of illegal gains, expert opinions and other evidence, innocence and leniency of the crime from three aspects: factual determination, evidence rules, and joint crime. He shared his defense experience in such criminal cases and provided useful reference and inspiration for future defense and research work.
